Personalization Terms of Sale

These Terms of Sale (these “Terms of Sale”) govern your purchase of product(s) on this website, including through any mobile version hereof (collectively, this “Site”). This Site and its related services and applications (collectively, this “Service”) is being offered by Baby Dove®, a Unilever Canada Inc. Brand, ("Baby Dove" or "we"). Baby Dove may, in its sole discretion and at any time, modify, suspend or discontinue these Terms of Sale and/or this Site or specific portions of it.
All orders made through the Site are subject to these Terms of Sale, as well as any other applicable terms and conditions outlined on the Site relating to the order. Pricing and other terms and conditions relating to the purchase, return, refund, or delivery of your order may be changed at any time without notice. Prices may differ from those for purchases made through other channels. You have a legal obligation to pay for any orders indicated to be made by you. By completing an order through the Site, you are agreeing to pay, in full, the prices and all applicable taxes and specified shipping and handling and other fees in relation to your order, either by credit card or other permitted payment method.
Baby Dove reserves the right, in its sole and absolute discretion, to change the permitted methods of payment, including without limitation, the credit cards and/or other types of payment options we are able to accept, at any time. If complete payment for your order is not received and verified by us, your order will not be processed. If you do not complete or improperly complete your order it may not be accepted or acknowledged.

1. Agreement to Be Bound
Your purchase of one or more products on this Site constitutes your agreement with Baby Dove and Nexus Commerce, Inc. to be bound by, and to act in accordance with, these Terms of Sale.

2. Orders and Shipping
a. General Order Information
Orders for merchandise are generally processed and shipped within approximately 2-10 (two-ten) business days.
In the unlikely event that we are unable to meet this delivery timeline, our Customer Care team will contact you and you will have the option to either wait for the product to become available or cancel the entire order.

b. Delivery Information
Orders will only be shipped and delivered to valid addresses (as determined by Baby Dove in its sole and absolute discretion) located within Canada. An order may only be shipped to one delivery address.
However, please note that we may not be able to ship to all valid addresses and, in such circumstances, we reserve the right in our sole and absolute discretion to cancel your purchase transaction. In the event we are not able to ship to the shipping address you provide, we will notify you, your order will be cancelled, and you will receive a refund in respect of your order (unless you are able to provide an alternate eligible shipping address).

c. Multiple Shipments
The merchandise you order may arrive in more than one box, but you will not incur any additional shipping charges under such circumstances. The total charges for all shipments, including the shipping charges, will be communicated during the checkout process.

d. Delivery Methods
Your shipment will arrive via Canada Post. Your order will typically be delivered within 2-10 business days.

The above are estimated delivery times; however, as we use a third party to deliver orders, it is possible that your order will arrive before or after the estimated delivery time. We will not be responsible for any delays in delivery which are beyond our control.

e. Baby Dove’s Rights Regarding Orders and Verification
Without limiting the generality of any other section of these Terms of Sale, Baby Dove reserves the right to limit or refuse any order you place with us. Further, we reserve the right to verify the validity of all orders and/or cancel any order if we find evidence of fraud, tampering and/or any other violation of these Terms of Sale, or any other agreement you may have with us. We may, in our sole and absolute discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same account, the same credit card or other payment method, and/or orders that use the same billing and/or shipping address. We also reserve the right, in our sole and absolute discretion, not to ship items ordered or purchased through the Site to certain addresses. In the event that we are unable to or choose not to ship an item, you will be notified accordingly and the amount for that item charged in relation to your order will be reduced accordingly.
All orders are subject to verification by Baby Dove at any time and for any reason. We reserve the right, in our sole and absolute discretion, to require proof of identity (in a form acceptable to Baby Dove): (i) for the purposes of verifying the legitimacy of any order and/or other information; and/or (ii) for any other reason we deem necessary, in our sole and absolute discretion, for the purposes of fulfilling an order in accordance with our interpretation of the terms and conditions of these Terms of Sale. In order to help protect you and Baby Dove from fraudulent transactions, we may provide your transaction-related information to a reputable third party organization to perform an address verification. This address verification is intended to ensure that the "bill to" address that you provide matches your credit card address.

f. Personalization.
Certain features on the Site may permit you to request the items you purchase be customized, for example, by including your name or a greeting on the product’s packaging (“Customization Feature”). If you use a Customization Feature, any content you provide for the purpose of customization is subject to and must comply with our Terms of Use. For greater certainty, all content you submit to a Customization Feature must comply with our Terms of Use, and you agree that we may use such content in accordance with our Terms of Use. In the event you provide us with content that violates our Terms of Use or any other guidance we may provide on the Site, we may cancel your order, in which case section 2.e. will apply.

3. Cancellations, Returns, Exchanges and Refunds
a. Sales Final, No Cancellations, Returns or Exchanges
As the Site allows you to customise the items you have purchased, once an order has been placed it may not be cancelled, nor can orders be returned or exchanged.

b. Defective or Damaged Merchandise
In the event that we processed your order incorrectly, or that you received a defective or damaged item, please call Nexus Commerce, Inc. Customer Service at 1-647-696-2113 Monday through Friday 8:00 am- 5:00 pm ET, and we will provide a full refund and/or replace the item. On some occasions, we will require defective or damaged items to be returned.

4. Price and Payment
All prices shown on the site are in Canadian Dollars and are exclusive of applicable sales tax. Sales tax will be applied to all orders shipped once in the checkout.
We reserve the right to change prices at any time without notice to you, provided that any changes made after your order is submitted will not apply retroactively.
Payment can be made through Visa, MasterCard & American Express or via your PayPal or Google Pay account. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us, we will not be liable to you for any delay or non-delivery of your order.
We allow you to use discount codes on the Site strictly in accordance with the terms and conditions upon which they were issued. We reserve the right to reject or cancel any order that does not comply with such terms and conditions. In the event of any inconsistency between the discount code terms and conditions and these Terms of Sale, the discount code terms and conditions shall prevail.

5. Promotions
From time to time we may in our sole and absolute discretion offer various promotions, including without limitation, promotions that can be applied to your order using a promotional code, which we will provide to you. To participate in such a promotion, you must enter the applicable promotion code in the space provided during the checkout process, before you submit your order. The value of the promotion will be applied to your order (but may not be displayed as a separate line item).
While the terms and conditions for each promotion may vary, most of our offers last for a limited time, and have associated promotional codes that can only be used once per customer, and cannot be combined with other offers. Promotional shipping offers will apply to orders that meet the particular promotional guidelines, such as the applicable merchandise total (before tax and shipping/handling charges are applied) and the requirement that the order be shipped to a single address.
Some offers will not have an associated promotional code – they can simply be added to your shopping cart, and the promotion will be applied, as long as you have met the other offer requirements.

6. Changes to these Terms of Sale
These Terms of Sale are current as of the effective date set forth above.
We reserve the right to change all or any portion of these Terms of Sale from time to time consistent with applicable laws and principles. If we do this, we will post the changes at least thirty (30) days before the amendment comes into effect, and will indicate at the top of this page the date these Terms of Sale were last revised. If you are a registered account holder, we may also provide you with notice of such changes setting out the new clause, or the amended clause and how it read formerly, and the date on which the change will come into effect using any contact information we may have available to us. You may refuse the amendment and rescind, or cancel your use of the Site and account without cost, penalty or cancellation indemnity, by sending us notice to that effect no later than thirty (30) days after the amendment comes into force, using the information in the notice. These changes will be effective as of the date we post the revised version on this Site. Your continued use of this Site after we have posted the revised Terms of Sale constitutes your agreement to be bound by the revised Terms of Sale. If at any time you choose not to accept these Terms of Sale, you may not use this Site or submit an order.

We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or modify or cancel orders if any information on the website is inaccurate at any time without prior notice (including after you have submitted your order).
